International Insolvency Law and the Treatment of Assets

Remigijus Jokubauskas

Law / Bankruptcy & Insolvency

This book examines how assets should be treated in cross-border insolvency proceedings and how the principle of the maximisation of asset value should guide the operation of international insolvency frameworks.

Analysing the different procedural stages involved in the treatment of assets – including tracing, preservation, recovery, administration, and realization – this book explains how these stages interact in cross-border insolvency proceedings. It further considers the role of insolvency practitioners, courts, and cross-border cooperation mechanisms in ensuring the effective management of assets located across multiple jurisdictions. The book demonstrates that the effective treatment of assets is central to achieving efficient insolvency proceedings and maximising returns for creditors in cross-border cases.

This book will be of interest to researchers working in the areas of commercial law, international dispute resolution, and law and economics; particularly those interested in value maximisation, collective enforcement mechanisms, and the economic objectives of insolvency systems.

Remigijus Jokubauskas is an attorney at law and an associate professor of insolvency law at Mykolas Romeris University (Lithuania).
