It situates these practices within a broader apparatus of state violence, tracing how they produce civic alienation, reinforce a culture of impunity, and erode the foundations of democratic governance, the rule of law, and civil liberties.

Divided into two parts, the book first explores the interrelationship between torture and political violence, drawing from legal theory, political sociology, and trauma studies. It raises critical questions: Does torture incite or mitigate terrorism? How does it influence public perception of the state and the legitimacy of its authority? What are the long-term psychosocial effects of torture on individuals and communities?

The second part turns to the practice of arbitrary detention, tracing its colonial legal lineage and its contemporary application through laws like the Public Safety Act (1978) and the Armed Forces Special Powers Act (1990). It theorises the practice of preventive detention as a mechanism of state control, analysing its impacts on youth, women, and civil society. The study highlights the psychological trauma, socio-economic disruption, and legal marginalisation inflicted upon individuals and communities subjected to this regime of exception.

Combining field-based research with legal and interdisciplinary analysis, this book offers a critical account of the human rights crisis in Kashmir. It will be of interest to scholars and practitioners in law, political science, conflict and security studies, South Asian studies, and international human rights.

Dr. Nassir Ul Haq Wani is an economist and social scientist whose scholarship spans economics, politics, international relations, and human rights, with extensive research engagement in Kashmir and Afghanistan.
