This book is the first collection of annotated cases in the field of foreign-related commercial adjudication, published for both international and domestic readers, and edited under the guidance of the Supreme People’s Court. This book was compiled by personnel from the Fourth Civil Division and related academic research bases, with the special contributions from members of the International Commercial Expert Committee of the Supreme People’s Court, as well as other leading scholars and practitioners. Each case is accompanied by an expert commentary, vividly demonstrating the achievements of China’s judicial services in supporting high-level opening-up through the “case-based approach to elaborating the law.”
This reflects the commitment of Chinese courts to maintaining an open stance towards the world, abiding by international treaty obligations, upholding the international law-based international order, and weaving the fabric of China’s judicial ethos with the rich tapestry of global legal achievements. This effort is of great significance for advancing both domestic and foreign-related rule of law, highlighting China’s achievements in this field, and helping to create a top-tier business environment that is market-oriented, law-based, and internationalized.
Chinese courts have been committed to providing high-quality judicial services to support the B&R. They have continuously deepened judicial exchanges and cooperation with B&R countries, striving to provide “Chinese solutions” for resolving international commercial disputes. Since 2013, the Supreme People’s Court has issued 35 judicial interpretations on foreign-related commercial and maritime matters, 12 normative documents, 18 guiding cases, and 191 typical cases. Courts at various levels have exercised jurisdiction according to law in foreign-related commercial and maritime trials, as well as in the judicial review of international arbitration. They have fulfilled treaty obligations in good faith, adhered to international practices, accurately applied governing laws, and adjudicated cases with significant precedential value. In doing so, they have equally protected the legitimate rights and interests of both Chinese and foreign parties, effectively demonstrating China’s approach to the rule of law in foreign-related matters.
