Parenting Capacity Assessment and Child Protection

A Framework for Practice

Peter Choate

Psychology / Forensic Psychology

This book provides an in-depth examination of parenting capacity assessments (PCAs) within the forensic and clinical assessment fields, tailored for use in child protection and family law cases. It integrates key legal, psychological, and social work perspectives, with a focus on cross-cultural, Indigenous, and diverse family contexts, addressing the increasing need for comprehensive and culturally informed evaluations in forensic practice.

The book begins by exploring the legal, ethical, and clinical foundations of PCAs, including the role of assessors as expert witnesses and the forensic implications of their testimony in court. In doing so, assessors are guided to know what is within their scope of practice as opposed to that which belongs to the courts. It distinguishes between PCAs used in child protection cases and those conducted for broader family law matters, highlighting the distinct challenges each presents in forensic settings.

Subsequent chapters delve into the integration of diverse family dynamics, emphasizing the historically overlooked perspectives of Indigenous, immigrant, and refugee families, as well as families with disabilities. The book offers practical, culturally sensitive tools, such as culturally based family mapping and storytelling methods, to ensure forensic assessments are both legally sound and responsive to the unique needs of these groups. The chapters help to avoid formulaic approaches to the work so that the unique needs of each case are addressed through clinically valid approaches. Each chapter features "Clinical Key Points," offering practical insights for forensic assessors, legal professionals, social workers, and psychologists engaged in child protection and family law. This book supports child protection workers examining why a referral is needed for a PCA and how to frame questions to serve the best interests of children and families while ensuring that an appropriate standard of care is considered relative to each referral.

This essential resource equips practitioners with the knowledge and tools to conduct PCAs that are legally defensible, culturally applicable, and aligned with both clinical and forensic best practices.
